On 5/1/2024, I, Officer McCune, was assigned to marked East-4, working for the Somerville Police Department. Around 1:45 AM, I was on routine patrol on Broadway, traveling westbound, when I reached the red light at the intersection of Broadway and School St. As I came to a stop, there was one vehicle in front of me bearing MA. Reg XXXX. The vehicle did not have any rear license plate lights, so I did a CJIS query on that plate. The CJIS query for that registration came back to John MURPHY (XXXX), who had a suspended license as well as two warrants. At this point, the light turned green, and we were now traveling on School St. when I activated my emergency blue lights to signal for the car to pull over. The vehicle did initially stop, but as I put my cruiser's spotlight on the vehicle, the car took off and fled the traffic stop. I would like to make note that while sitting at the red light, I did notice that the driver was wearing a baseball hat.

     I then radioed into dispatch the attempted motor vehicle stop and the direction that the vehicle was traveling. I discontinued the stop due to the driver's erratic operation. At this point, I decided to conduct a follow up investigation with East-3 (Ofc. LAVEY III), and went to MURPHY'S listed address obtained through CJIS, which is 164 Highland Ave. in Somerville. While traveling westbound down Highland Ave. in the area of MURPHY'S residence, I noticed a man, who was wearing a baseball hat, come running out of the parking lot of the Little Sister's retirement home located at 186 Highland Ave., which is extremely close to MURPHY'S residence. Due to the suspicious nature of this individual, and it being so close to MURPHY'S residence, I conducted a threshold inquiry. I radioed to dispatch to let them know that I would be speaking with that individual at the armory on Highland Ave. Multiple other units responded to that location. As I pulled up and exited my cruiser, I immediately recognized this man to be John MURPHY from his RMV picture. While speaking with MURPHY, I could tell that he was very nervous, breathing rapidly, and was evasive when answering my questions. I asked MURPHY what his name was and where he was coming from. He told me that his name was "XXXX" and gave me a birth date of XXXX, and he said that he was coming from Davis Square. I then asked him if he was coming from Davis Square, why did I just see him running from across the street. At this point, Officer E. O'Brien (W5) arrived on scene and immediately recognized the individual to be MURPHY from previous encounters. I gave MURPHY multiple chances to tell me where he was coming from and what his real name was, but he kept saying that his name was "XXXX." I CJIS queried the information he gave, and there were no records found on XXXX (XXXX). A set of Lincoln car keys were found on MURPHY after a search was done.

   

     Other responding officers searched the surrounding area for his vehicle. Officers E. O'Brien and R. LAVEY III located the vehicle with the same registration in the parking lot of St. Catherine Church. St. Catherine Church parking lot has direct access to a set of stairs that leads down to the Little Sisters retirement home property. The officers retrieved the car key located on MURPHY'S person and attempted to see if the keys matched the car. Officer Lavey III confirmed that the keys did, in fact, match the car. At this point, I radioed to dispatch to send Unit 200 (the prisoner transport van) to my location. I then read MURPHY his Miranda rights. MURPHY then started complaining that he could not breathe, so I asked for dispatch to send EMS to our location. MURPHY was transported to Cambridge Hospital. I rode in the ambulance, and Officer Lavey III followed. MURPHY was assessed and treated by staff at Cambridge hospital and then released. Unit-200, operated by Ofc. Sergio Costa, picked me up and MURPHY at the hospital. He was transported back to the station and booked in the usual manner by Lt. DeOliveira.

    

     In addition to the two warrants (Docket 2410CR000385, Docket 2447CR000271), I will also be charging MURPHY with the following:

     IDENTIFY SELF, MV OPERATOR REFUSE c90 S25

     I placed Massachusetts Uniform Citation T2916456 with MURPHY'S property.
