The following is a summary of the details related to this incident.

               

                On Saturday, April 20, 2024, I, Officer David Ruf, was in full-uniform and assigned to marked cruiser East-3, for the Somerville Police Department. At approximately 5:56 A.M., Officer Cleary (East-1) and I were dispatched to 14 McGrath Hwy (McDonalds) for a stolen mv. Somerville dispatch informed units that the stolen mv was a blue Hyundai Elantra and that it was occupied.

                Upon arrival I met with the reporting party, XXXX, who flagged me down and was pointing in the direction of a blue Hyundai Elantra parked in front of Star Market. I made my way over to the mv and parked my cruiser directly in front of the Hyundai. I observed a male party, later identified as Angel DeJesus, being the sole occupant of the mv. He was in the drivers seat with the vehicle running and when he saw me park, he shut the car off and stepped out of the vehicle. I asked him whose car it was and he said a friend "XXXX" let me borrow it. I had Somerville dispatch verify the status of the vehicle and they informed me that it was indeed stolen. I placed Angel in handcuffs and read him his Miranda rights from a card I keep on my persons. He refused to answer any additional questions.

                I then spoke with XXXX through the translation of Sgt. Scrugli and learned the following; he was using his sister's car to do Uber eats. He came to McDonald's for a pick up and observed his mv parked in the lot occupied by someone wearing a hoodie. He stayed infront of McDonalds and called 911.

                Angel is being charged with the following;

M.G.L. c266 / ยง28 RECEIVE STOLEN MOTOR VEH

                He was transported by Unit #200, Officer Rivera, to the Somerville Police Headquarters where he was booked by Lt. DeOliveira in the usual manner. The vehicle was turned over to XXXX.
